Comprehensive Policy Against Child Sexual Abuse and Exploitation (CSAE)

Agapé ("we," "us," "our," or the "Company") is unequivocally committed to the protection of minors and the prevention of child sexual abuse and exploitation. This Child Safety Standards document ("Policy") establishes our comprehensive framework for preventing, detecting, reporting, and responding to any form of child exploitation on our platform.
Absolute Zero Tolerance Policy
Agapé maintains an ABSOLUTE ZERO TOLERANCE policy for Child Sexual Abuse Material (CSAM), Child Sexual Abuse and Exploitation (CSAE), and any content or behavior that endangers minors. Any account found to be in violation of this policy will be immediately and permanently terminated, all evidence preserved, and the matter reported to law enforcement authorities and NCMEC. There are no warnings, no appeals, and no exceptions.
1. Definitions and Scope
1.1 Key Definitions
For the purposes of this Policy:
- "Minor" or "Child" means any individual under the age of eighteen (18) years, or the age of majority in their jurisdiction if higher;
- "CSAM" (Child Sexual Abuse Material) means any visual depiction, including photographs, videos, digital images, or computer-generated images, of sexually explicit conduct involving a minor;
- "CSAE" (Child Sexual Abuse and Exploitation) means any conduct that sexually exploits or abuses a child, including but not limited to grooming, sextortion, trafficking, and solicitation;
- "Grooming" means the deliberate actions taken by an adult to establish an emotional connection with a minor for the purpose of sexual abuse or exploitation;
- "Sextortion" means the threat to expose sexual images or information about a minor to coerce the minor into providing additional sexual content, money, or other demands.
1.2 Scope of Application
This Policy applies to all users, content, communications, and activities on the Agapé platform, including but not limited to profile information, photographs, messages, and any external links shared through the Service.
2. Age Verification and Access Restrictions
Agapé is a platform exclusively for adults aged 18 years and older.
2.1 Age Verification Measures
- Registration Gate: All users must confirm they are 18+ during account registration through date of birth verification;
- Terms Acceptance: Users must affirmatively accept our Terms of Service and EULA, which explicitly state age requirements;
- Ongoing Monitoring: We actively monitor for indicators suggesting underage users.
2.2 Underage User Discovery
If we determine or reasonably suspect that a user is under 18 years of age:
- The account will be immediately suspended;
- All associated data will be deleted (unless preservation is required for law enforcement purposes);
- The user will be permanently prohibited from creating new accounts;
- If there is any indication of exploitation, the matter will be reported to authorities.

3. Prohibited Content and Conduct
The following content and conduct are strictly and absolutely prohibited on Agapé:
3.1 Prohibited Content
- Any CSAM or visual depictions of minors in sexual situations;
- Sexualized content involving minors, including drawings, animations, or AI-generated imagery;
- Content depicting, promoting, or glorifying child abuse;
- Content that sexualizes or objectifies minors in any way;
- Links to external sites containing CSAM or exploitation material.
3.2 Prohibited Conduct
- Grooming: Any attempt to build trust with a minor for sexual purposes;
- Solicitation: Requesting sexual images, videos, or acts from minors;
- Sextortion: Threatening or blackmailing involving sexual content of minors;
- Distribution: Sharing, trading, or distributing CSAM;
- Facilitation: Using the platform to arrange offline meetings for exploitation;
- Advertising: Any content suggesting availability of minors for sexual purposes.
4. Detection and Prevention Systems
Agapé employs multiple layers of technological and human review to detect and prevent child exploitation:
4.1 Automated Detection
- Image Analysis: We use Google Cloud Vision API and similar technologies to scan uploaded images for potentially harmful content;
- Hash Matching: We compare image hashes against known CSAM databases;
- Behavioral Analysis: Automated systems flag suspicious communication patterns indicative of grooming;
- Age Estimation: AI-based analysis may be used to flag content potentially depicting minors.
4.2 Human Moderation
- Trained Trust & Safety personnel review flagged content;
- All user reports are reviewed by human moderators;
- Escalation procedures for confirmed or suspected CSAM.
4.3 Proactive Measures
- Regular audits of platform content and user behavior;
- Continuous improvement of detection algorithms;
- Collaboration with industry partners and NGOs.
5. In-App Reporting Mechanisms
In compliance with Apple App Store and Google Play Store safety requirements, Agapé provides accessible, prominent, and easy-to-use reporting mechanisms:

- Navigate to the suspicious user's profile;
- Tap the "Options" icon (three dots or flag icon);
- Select "Report";
- Choose the appropriate category:
- "User appears to be a minor"
- "Inappropriate/illegal content"
- "Suspicious behavior toward minors"
- Provide any additional details;
- Submit the report.
5.1 Report Processing
- Priority Queue: Reports involving potential CSAE receive highest priority;
- Response Time: We commit to reviewing CSAE-related reports within 24 hours, typically much faster;
- Anonymity: Reporter identity is kept confidential and never disclosed to the reported user;
- No Retaliation: Users who report in good faith are protected from any retaliation.
6. Enforcement Actions
When CSAE-related violations are confirmed or reasonably suspected:
6.1 Immediate Actions
- Content Removal: Offending content is immediately removed from all systems;
- Account Termination: The account is permanently and irrevocably terminated;
- Device Ban: Device identifiers are blocked to prevent new account creation;
- IP Logging: Associated IP addresses are logged for law enforcement.
6.2 Lifetime Ban
Users terminated for CSAE violations are permanently banned from all Agapé services. Any attempt to create new accounts will result in immediate termination and additional reporting to authorities.
6.3 No Appeals for CSAE
Unlike other policy violations, there is NO APPEAL PROCESS for accounts terminated due to CSAE violations. This decision is final and irreversible.
7. Law Enforcement Cooperation
Agapé fully cooperates with law enforcement agencies investigating child exploitation:
7.1 Voluntary Disclosure
We will voluntarily disclose information to law enforcement when we reasonably believe there is an imminent threat to a child's safety or evidence of ongoing exploitation.
7.2 Legal Process Response
- We respond to valid legal process (subpoenas, court orders, search warrants) in accordance with applicable law;
- Emergency disclosure requests are processed on an expedited basis;
- We maintain 24/7 contact capabilities for urgent law enforcement requests.
7.3 Jurisdictional Cooperation
We cooperate with both Spanish authorities (Policía Nacional, Guardia Civil) and international agencies as appropriate.
8. NCMEC CyberTipline Reporting
Mandatory Reporting: In accordance with U.S. federal law (18 U.S.C. § 2258A) and international best practices, Agapé reports all instances of apparent CSAM to the National Center for Missing & Exploited Children (NCMEC) through the CyberTipline.
8.1 Report Contents
Our CyberTipline reports include:
- All available information about the uploader/sender;
- Preserved copies of the offending material (in secure, law-enforcement-accessible format);
- IP addresses, timestamps, and device information;
- Any communications related to the material;
- Information about any identifiable victims.
8.2 International Distribution
NCMEC coordinates with INTERPOL and national agencies worldwide, ensuring reports reach appropriate authorities regardless of jurisdiction.
9. Data Preservation and Evidence Handling
9.1 Preservation Procedures
When CSAE is detected or reported:
- Evidence Preservation: All relevant data is preserved in secure, forensically sound manner;
- Chain of Custody: Strict chain of custody is maintained for potential criminal proceedings;
- Retention Period: Evidence is retained as required by law or until instructed otherwise by law enforcement.
9.2 Staff Access Controls
- Access to preserved CSAE evidence is strictly limited to authorized Trust & Safety personnel;
- All access is logged and audited;
- Staff undergo background checks and specialized training.
10. Platform Liability Limitations
IMPORTANT LEGAL NOTICE: While Agapé employs significant resources to detect and prevent CSAE, no detection system is perfect. Agapé cannot guarantee that all prohibited content will be detected or prevented.
10.1 Good Faith Efforts
Agapé acts in good faith to implement industry-standard protections and exceeds minimum legal requirements. Our systems are continuously improved based on emerging threats and technologies.
10.2 User Responsibility
Users are ultimately responsible for their own conduct and content. By using Agapé, users represent that they are adults and will not engage in any prohibited conduct.
10.3 Limitation of Liability
To the maximum extent permitted by applicable law, Agapé shall not be liable for content uploaded by users or the actions of third parties on the platform. This limitation does not affect our commitment to robust safety measures and cooperation with authorities.
