Terms and Conditions of Use

2. Eligibility and Account Requirements

Use of Agapé is a privilege, not a right. To use the Service, you warrant that:

1. You are at least 18 years old. Use by minors is strictly prohibited.
2. You have not been convicted of any sexual offense, violent crime, harassment, or hate crime in any jurisdiction.
3. You are not required to register on any sex offender registry (state, federal, or local).
4. You will use the platform for an honorable purpose aligned with Christian values of respect and dignity.

3. Community Rules and Zero Tolerance (EULA)

Agapé maintains a ZERO TOLERANCE policy regarding objectionable content and abusive behavior. We reserve the right to investigate, suspend, and permanently ban any account that violates these rules.

3.1 Prohibited Content

You strictly agree NOT to upload, share, or transmit content that:

• Is defamatory, harassing, threatening, or incites violence.
• Is obscene, pornographic, sexually explicit, or contains nudity.
• Promotes racism, bigotry, hatred, or physical harm against any group or individual.
• Constitutes "spam," unsolicited advertising, or pyramid schemes.
• Impersonates another person or entity.

3.2 Reporting Mechanisms and Moderation

Agapé provides in-app tools for users to report inappropriate content or behavior (blocking and reporting features). We are committed to reviewing reports and taking action (including removing content and blocking or banning the offending user) within 24 hours of receiving the notification.

5. Intellectual Property and License

Your Content: You retain ownership of your photos and profile. By posting them, you grant us a worldwide, royalty-free, transferable license to use, copy, display, and adapt such content for the purpose of operating and improving the Service.

DMCA / Copyright: We respect copyright laws. If you believe your intellectual property has been infringed, please contact us at support@meetagape.com, and we will remove the infringing content in accordance with the law.

6. Purchases, Refunds, and Withdrawal

6.1 Payment Management

Premium subscriptions are managed directly through your Apple App Store or Google Play Store account. Agapé does not store your financial information.

6.2 Automatic Renewal

Subscriptions renew automatically. To cancel, you must do so from your device settings at least 24 hours before the end of the current period.

6.3 Right of Withdrawal (EU) and Refunds

For users in the European Union: In accordance with the Consumer Rights Directive, by purchasing digital content and accessing it immediately, you explicitly agree that the service has begun and you lose your 14-day right of withdrawal.

General: All purchases are final and non-refundable, unless required by applicable law. Refund requests must be directed to Apple or Google, as they process the payment.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW (AND EXCEPT FOR CONSUMERS IN THE EU WHERE THIS LIMITATION MAY BE RESTRICTED):

AGAPÉ, ITS AFFILIATES, EMPLOYEES, AND OWNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR PHYSICAL OR EMOTIONAL DAMAGES, ARISING OUT OF: (I) YOUR ACCESS TO OR USE OF THE SERVICE; (II) THE CONDUCT OF OTHER USERS; OR (III) UNAUTHORIZED ACCESS TO YOUR DATA.

8. Indemnification

You agree to indemnify, defend, and hold harmless Agapé, its owner (Iván Rojas Manzano), affiliates, employees, and agents from any claims, demands, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service or your content.
• Your violation of these Terms.
• Your violation of the rights of any third party, including other users.
• Your violation of any applicable law.

9. Class Action Waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND AGAPÉ AGREE THAT ANY DISPUTE WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, OR ANY OTHER REPRESENTATIVE PROCEEDING.

10. Provisions for App Store and Google Play Users

You acknowledge that these Terms are between you and Agapé, and not with Apple Inc. ("Apple") or Google LLC ("Google").

• Agapé, not Apple/Google, is solely responsible for the Service and its content.
• Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the App.
• Apple and Google are "third-party beneficiaries" of these Terms and have the right to enforce these Terms against you.

11. Governing Law and Jurisdiction

• For users in the European Union: These terms are governed by the laws of Spain. As a consumer, you benefit from any mandatory provisions of the law of the country in which you reside. Nothing in these terms affects your rights as a consumer to rely on such mandatory provisions of local law.
• For users outside the EU (International/USA): These terms are exclusively governed by the laws of Spain. You agree to submit to the personal and exclusive jurisdiction of the courts of the city of Córdoba, Spain to resolve any dispute, waiving any objection of inconvenient forum.

Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision shall be removed, and the remaining provisions shall remain in full force and effect.

12. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will notify you through the App. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
